These Terms apply to all visitors, enquirers, and clients. Where a separate written engagement agreement is in place between Bumi Consult and a client, the engagement agreement takes precedence over these Terms in matters of service delivery.

This Site is provided for general informational purposes relating to Bumi Consult's services and capabilities. You may use the Site for personal, non-commercial purposes in accordance with these Terms.

You agree not to:

  • Use the Site in any way that violates applicable Malaysian law or regulation
  • Attempt to gain unauthorised access to any part of the Site or its underlying systems
  • Transmit any unsolicited communications or spam through any contact mechanism on the Site
  • Reproduce, distribute, or republish any content from the Site without our prior written consent

3. Consulting Engagements

All consulting services offered by Bumi Consult are subject to a formal written engagement agreement, which is provided to prospective clients before any work commences. These Terms & Conditions supplement, and do not replace, the specific terms set out in that agreement.

Enquiries submitted through this website do not constitute a commitment or contract on either side. An engagement is only formed once both parties have signed a written agreement and any required deposit has been received.

We aim to work collaboratively and transparently throughout every engagement. Our approach is advisory in nature — we provide structured analysis, facilitation, and recommendations, but the implementation of any plan remains the responsibility of the client organisation.

Client Responsibilities

To enable us to provide effective advisory support, clients are expected to:

  • Provide reasonably accurate information about their business and operating context
  • Make relevant members of the leadership team available for structured sessions as agreed
  • Review deliverables and provide feedback within agreed timeframes
  • Inform us promptly of any material changes to their situation that may affect the scope of work

4. Fees & Payment

Service fees are as described on this website and in the written engagement agreement. All fees are quoted in Malaysian Ringgit (RM) and are exclusive of applicable taxes unless stated otherwise.

Payment terms are set out in the engagement agreement. Standard terms require a deposit upon signing, with the remainder due at agreed milestones or upon completion. We reserve the right to pause work if payments fall materially overdue.

We may revise our published fees from time to time. Revisions do not apply retroactively to engagements already agreed in writing.

5. Cancellation & Postponement

If you need to cancel or postpone an agreed engagement, please notify us in writing as early as possible. Specific cancellation terms, including any applicable fees, are set out in the engagement agreement.

In general, work already completed at the point of cancellation will be charged at the agreed rate. Deposits may be non-refundable depending on the notice given and the stage of work reached.

We reserve the right to withdraw from an engagement if there is a material breakdown of the working relationship, if we are provided with significantly inaccurate information, or if continuing the engagement would be contrary to our professional standards. In such circumstances, we will give reasonable notice and will not charge for work not yet commenced.

6. Intellectual Property

All content on this website — including text, design, graphics, and structural elements — is the intellectual property of Bumi Consult and is protected under applicable Malaysian copyright law. No content may be reproduced, distributed, or adapted without our prior written consent.

Deliverables produced as part of a consulting engagement (such as strategic documents, roadmaps, and workshop materials) are subject to the intellectual property provisions in the engagement agreement. Standard practice is that deliverables become the client's property upon full payment, while our methodologies and frameworks remain our property.

Feedback, testimonials, and case study content shared by clients may be used by Bumi Consult for illustrative purposes unless the client requests otherwise in writing.

7. Confidentiality

We treat all information shared by clients as confidential. Our consultants do not disclose client-specific information to third parties without consent, except where required by law.

We may reference the general nature of engagements (sector, size, type of work) in aggregate form or for illustrative purposes, but will not identify clients by name without their express permission.

Formal confidentiality obligations are typically set out in the engagement agreement and may include mutual non-disclosure provisions where appropriate.

8. Limitation of Liability

Our advisory services are designed to support better decision-making, not to replace the judgment of the leadership teams we work with. We cannot accept liability for business outcomes that result from decisions made by clients, even where those decisions have been informed by our work.

To the extent permitted by Malaysian law, our total liability in connection with any engagement is limited to the fees paid for that engagement. We are not liable for indirect, consequential, or incidental losses of any kind.

Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence, or any other matter that cannot be excluded by law.

Information on this website is provided in good faith and to the best of our knowledge at the time of publication. We do not warrant that it is complete, current, or free from error.

9. Third-Party Links

This website may contain links to external websites operated by third parties. These links are provided for your convenience only. We have no control over the content or availability of third-party sites, and the inclusion of a link does not imply endorsement.
